What to look out for when leasing equipment
It is very difficult to determine whether a lease is an operating lease or a finance lease simply from the documentation presented to you. If you are engaging into a lease agreement as a public sector organisation you must ensure the lease is an operating lease and complies with the International Accounting Standards (IAS) 17 otherwise the agreement is ultra vires.(unenforceable).
